This website uses forms that allow you to enter information associated with your account, including your name, email address, firm name, phone number, and a password. Equity Squared retains this inforrmation, and your IP address in our database to verify that your account is valid, and that you have consented to this Privacy Policy, to the Terms of Service, and that you have represented that you have your law firm's permission to store confidential client data on Equity Squared's systems. Your password is "hashed" before it is stored in our database. This means only an encrypted version of your password is stored. Equity Squared will not have access to the human-readable password that you supply when you create your account. Equity Squared cannot recover lost passwords. If you forget your password, the password reset tool will email you a link to allow you to create a new one.
In addition to account-specific information, this Website allows you to enter information about Matters and the parties to those matters, to provide information about the parties' financial circumstances including but not limited to their assets, liabilities, sources of income, and expenses, and to upload documents that you provide. All information that you provide through the Website is maintained in our database and/or in Amazon Web Services' S3 storage infrastructure.
We use Stripe to process credit card transactions. Stripe collects additional information for billing and verification purposes, and the retention and dissemination of that information is governed by Stripe's polices.
The Website uses cookies, which are transmitted to your web browser and stored by your web browser. The Website cannot function properly unless you allow your web browser to accept and retain cookies from it. We use these cookies to maintain your account information, and information about your session while you are using the Website.
Our web servers, load balancers, databases, S3 object stores, and other infrastructure generate activity and error logs, and those logs contain information that could potentially identify you such as your IP address, the request string, the file name(s), and date and time of each request. This information is recorded for troubleshooting purposes, and to investigate potential breaches of our servers. We discard it from time to time after it is no longer needed.
We may store other information that you provide to us using other methods such as telephone contact, written correspondence, email, etc. If you contact Equity Squared for customer or technical support, we may keep a record of the support that was given.
By default, we will not view the names of your Matters, party names, documents you upload, data that you enter for balances, assets & liabilities, sources of income, expenses, or tags. Our administrative tools will allow us to see truncated names of matters (the first and last few characters of the Matter Name), the matter's unique identifier (UUID), the date the matter was created, the date the matter was last viewed or updated, the status of the matter (open, closed, pending deletion, etc), the name of the Team the Matter is assigned to, the name of the user that created the Matter, and information about the Matter Credit applied to create the Matter including the date it was purchased, the price paid, the purchaser, and the transaction information. We may use this information for any purpose, including but not limited to making decisions about infrastructure and storage needs, determining if dormant matters are being retained for longer than a reasonable retention period, and verifying compliance with our agreements with you.
We may also log non-specific information related to a matter, such as whether there is a resurgence of activity on a Matter that had been dormant for some time, whether someone deleted all or substantially all of the data associated with the Matter, or whether someone took other actions which evidence a potential effort to circumvent our "Per Matter" pricing structure. We may use this information to police our agreements with you, including in litigation if we believe you have materially breached one of our agreements.
If you give our support team permission to view a Matter, we will have full access to all information and documents associated with the Matter, but we will only use that access to assist you in using the Website.
We will use your name, email address, telephone number, and other contact information to contact you concerning your use of the site. Examples of such contact include, but are not limited to password reset requests, notifications that you have been invited to participate in other Teams, notifications that other users have joined one of your Teams, receipts, and other transaction information. Unless you opt out, we may also use your contact information to notify you of promotions, new features, or tips for using the Website.
We may use your transaction history (i.e., when you have purchased Matter Credits, how many, and for how much) to devise marketing strategies and, if you have not opted out of marketing communications, to send you promotions or other marketing materials.
You and/or your client own all Matter information, documents, and data about your client's assets and liabilities that you supply to us. We will not sell your contact information, Matter information, data, or documents that you have added to the Website, nor will we share it with any third parties, except in response to a legal request.
We will cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe is necessary or appropriate to respond to claims and legal process (including without limitation subpoenas), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical. If we receive a subpoena or other legal process, and if we are permitted to notify you of it, we will notify you using the most recent contact information that you maintain in your account with us. You are responsible for keeping your contact information up to date.
If you fail to login to your Equity Squared account for a period of 24 continuous months, we shall have the right to deeem your account to be abandoned. In the case of an abandoned account, we will retain information that we have collected from you until we determine, in our sole discretion, that such information no longer serves a business purpose. At such time, we may delete the information.
We reserve the right to change this policy at any time. If we elect to change this policy, we will post the changes to this page, and other places that we deem appropriate so that you are aware of the new policy.
